Job Description

Principal Legal Adviser – Legal Services

  • Are you a public lawyer with a depth of expertise in the development of legislation?
  • Do you thrive on providing robust and creative solutions?
  • Are you able to mentor other lawyers to achieve best practice?

We've realigned our legal team to support MPI's business units.  As part of this process we have identified the need to appoint a lawyer who can provide professional leadership in the design, development and drafting of legislation, to ensure we maintain our high level of expertise in this area.

Mō tō mātou rōpū | About our team

Legal Services contributes to the achievements of MPI by advising on legal risks and opportunities, helping to deliver legally robust solutions, and turning policy into effective legislation.  We enjoy working in (and on) the complex and fascinating statutory regimes that MPI administers, knowing that what we do protects our environment and enhances the prosperity of New Zealanders.  We are proud of our inclusive and supportive directorate culture, and strive to maintain that.

Kōrero mō te tūranga | About the role

We have recently moved three of our teams from a structure based on legal functions, including legislation, to a structure focussed on supporting MPI's business units.  We need to ensure that this structural change does not cause us to lose our high level of expertise in all stages of the design, development and drafting of legislation, from engagement with policy advisers over the design of Acts and regulations, through Cabinet and Parliamentary processes, to the production of clear and effective delegated legislation.

You will provide professional leadership across our legislative work, supporting our lawyers to achieve best practice in design and development of legislation, and assisting them to work effectively with policy advisors, Parliamentary Counsel, and other departments.  You will also assist them to resolve issues in the drafting of delegated legislation that is issued within MPI.  MPI issues a significant volume of delegated legislation, which can give rise to difficult questions of principle about design and drafting appropriate for the particular context.

You will also manage co-ordination of the development of Acts and regulations across Legal Services, helping to resolve competing priorities and overseeing our work on legislation that ranges across more than one of MPI's regulatory systems.

You will need to earn the trust of our senior leaders as an adviser who can facilitate delivery of effective legislation.  You will have the collegial support of your peers in a leadership team, including the managers of the system-based teams who are responsible for the staff working on individual pieces of legislation.

Mōu | About You

To join us you will need:

  • To be qualified to practise law in New Zealand and a current practising certificate (or eligibility to hold a practising certificate);
  • Extensive knowledge of government legal frameworks, public law, and the principles of the Treaty of Waitangi;
  • Extensive knowledge of legislative processes and best practice in the design, development and drafting of legislation (primary and delegated);
  • Ability to gather, organise and communicate information quickly;
  • Ability quickly to understand the nature of a problem, identify a range of possible solutions, form conclusions and provide advice.
